Detention in the system of measures of criminal procedural coercion is one of the debatable issues in modern science, due to the mechanism of selection of this preventive measure, issues of compliance with the rights of the accused or suspect in its selection, problems of compliance with the terms of detention. Detention is one of the strictest preventive measures, which is the isolation of a person from society on the basis of a court decision. On this basis, there are numerous discussions in the scientific literature on the essence of detention, the procedural procedure for the selection of this preventive measure, as well as respect for human and civil rights and freedoms in its selection. In general, the analysis of the modern system of preventive measures shows that the use of detention raises a number of problems both theoretical and methodological as well as practical plan, which determines the relevance of the study of this problem carried out in this paper.
